1. Description:
The following conditions apply to all property rentals agreed to between FLATSinISTANBUL (referred to as 'The OWNER') and all property renters (referred to as 'The CLIENT').
The OWNER accords to the CLIENT a short term residence or 'holiday home', in accordance with the conditions stated below, which the CLIENT must adhere to. The above mentioned residence is to be used only for personal use, and under no means is to be used for any professional purposes, or as a business unit or office. The CLIENT understands and accepts that the accommodation and services are only provided in the framework of a business or pleasure trip to Istanbul and that this is the principle underlying condition to the validation of this contract.
The agreed upon rental fee includes linens, standard kitchen utensils, electricity, water, gas bills, cleaning and all taxes.
The CLIENT (including all accompanying family members and acquaintances) agrees to commit no act that could disturb the tranquility of the other residents of the building where the rental occurs. Any disorderly or unruly behavior is the sole responsibility of the CLIENT and the OWNER relinquishes complete and absolute responsibility if a third party is involved. The CLIENT must comply with the building regulations.
Animals are not allowed in properties except through prior arrangement.
During the rental of the property the OWNER reserves the right to carry our urgent work in the property (agreed to with the CLIENT), without affecting the negotiated price. The CLIENT agrees to allow the OWNER access into the property with prior notice of at least one day (except in cases of emergency), in order to accomplish these tasks.
The CLIENT understands that the OWNER undertakes no responsibility for the CLIENT’s personal belongings and that in case of loss, damage, or theft to CLIENT's personal property. The CLIENT shall not attempt to recover damages from the OWNER.
The CLIENT is responsible for any defacement to the property during his/her stay. The CLIENT shall exercise reasonable caution to prevent the occurrence of theft including locking all doors and windows during the times that he/she is not inside the property. In case of theft because of the CLIENT's own intention or neglectfulness, the CLIENT agrees to be responsible (either personally or through CLIENT's insurer) for items and furnishing belonging to the OWNER that are not included in the OWNER's insurance policy.
Booking & Security Deposit
To complete the reservation The CLIENT agrees to pay the Security Deposit to The OWNER. The rent will be paid upon arrival to the flat in cash only. The Security Deposit can be paid by wire transfer to The OWNER's bank account, via PayPal by credit card, through Western Union fund transfer system or in cash. The rent cannot be paid via Paypal or by credit card.
It is necessary to pay the Security Deposit to book the flat. When Security Deposit payment reaches The OWNER's account, The OWNER will close sales of the flat and will confirm the reservation to The CLIENT. In failure of the Security Deposit payment, The OWNER will not reserve any flat for The CLIENT. This Security Deposit payment can not be taken as the whole or a part of the rental fee.
The Security Deposit will be refunded to The CLIENT after the flat's inspection during check-out. Cash Security Deposit payments will be returned to The CLIENT on check-out date after the flat's inspection. PayPal security deposit refunds may take 24-48 hours to reach The CLIENTS account.
During the proposal process, flats maybe reserved/rent online or by another proposal. Without The OWNER's written confirmation and the Security Deposit payment, any proposal shall not be confirmed as a final and valid reservation.
The OWNER's proposals/offers may be valid for a period of time. After this period, The OWNER reserves the right to change the price and/or the availability of the flat(s).
Payment
The CLIENT agrees to pay the rental fee in full during check-in to the flat. The OWNER reserves the right to refuse to provide accommodation to The CLIENT if this payment is not done. In case of extension of the reservation, The CLIENT agrees to pay the amount in full and on the day the extension starts. If The CLIENT wants to check-out earlier than the agreed date, The OWNER reserves the right to refuse to pay the rental fee corresponding to the unused days.
The rental fee should be paid in cash during check-in or advance payment by wire transfer or by Western Union fund transfer system. We do not accept payments with credit card.
When you are transferring money, please make sure with your bank that bank transfer costs (sender’s & receiver’s) are fully paid from the beginning. We do not hold any responsibility for transfer reductions from our NET rental price given at the beginning of this contract.
For any reason, if the CLIENT cancels the reservation for the property once the contract has been executed, the deposit is non-refundable unless the OWNER is able to re-rent the property for the agreed rental period. If the OWNER is unable to re-rent the property for the said dates, the OWNER reserves the right to keep 100% of CLIENT's payment with the understanding that if the OWNER succeed in re-renting the property for said dates, the payment will be refunded less 30 Euro administration fee. The OWNER will not be held responsible for cancellation. Cancellation insurance is the renter's personal responsibility. We strongly recommend you to take a travel insurance.
It is unlikely that the OWNER will have to make any changes to confirmed arrangements once CLIENT's deposit has been received. However, in the unlikely event of a "force majeure", (events outside our control), the OWNER accepts no liability whatsoever in respect of any alteration, cancellation, loss or damage caused by political unrest, war, riots, civil strife, industrial disputes, strikes, Governments, natural or nuclear disaster, fire, storms, floods, epidemics, quarantines, medical or customs regulations, technical or administrative problems with transport, closure of airports, or any other occurrences amounting to "force majeure" and/or acts of God.
OWNER or his representative will be waiting for you at the property.
The CLIENT is expected to arrive between 15:00 and 22:00. The CLIENT is also requested to vacate until 12:00 (at noon).
OWNER provides Free airport (Ataturk Airport) pick-up for stays longer than 7 nights. The CLIENT may take airport service on departure in return for 25/35 Euros.
For the arrivals before 15:00, we are happy to help you as long as the property is available for an early check-in.
Upon arrival at the property, the CLIENT agrees to leave with the representative of the OWNER a security deposit. The deposit given by the CLIENT guarantees the OWNER payment for any damage made by the CLIENT to any appliances, furniture, upholstery, kitchen utensils, linens, towels, etc. The CLIENT also agrees to leave the property in the same state as when the CLIENT entered the property. The deposit will be returned in full to the CLIENT on the day of his/her departure, once the OWNER verifies the inventory of the property and verifies that no damage has occurred to the property. In case the observed damage exceeds the amount left as a deposit by the CLIENT, the CLIENT agrees to pay in full for the excess cost.
Upon arrival at the property agreed to between the OWNER and the CLIENT, the CLIENT agrees to sign the inventory of the property at which time a copy will be given to both CLIENT and the OWNER. The CLIENT is expected to sign the inventory upon his/her departure, as well. The deposit will be returned to the CLIENT once the departure inventory has been done and the OWNER agrees that no damage has occurred and no items are missing.
“The deposit will not be returned unless the flat is evacuated by the CLIENT “
The deposit will be handed in after the flat has been checked and the keys have been returned. As for our guests that stay as a group in the flat, the above will be completed only after the last guest leaves the flat
